Now, right after the, the Munich Regional Court has denied Apple’s request to put a ban on Samsung’s Galaxy Tab 10.1N and the Galaxy Nexus. Well, I guess Apple is learning about the saying “You win some, you lose some”.
Samsung has lost two patents so far in their battles with Apple. The judge presiding over the case, Andreas Mueller, said this while delivering the verdict. “Samsung has shown that it is more likely than not that the patent will be revoked because of a technology that was already on the market before the intellectual property had been filed for protection”.
Mueller doesn’t agree with the courts in Dusseldorf and Mannheim, who have lower standards for more recently granted patents.”We don’t share the idea that young patents are less valuable than those who have survived for a longer period of time” he said.
The European Commission also revealed that they were going to look into whether or not Samsung broke the 1998 agreement to license any standard essential patents on “fair, reasonable and non-discriminatory terms”.
Apple and Samsung are going at each other strong, but which of them will come out on top?
